License Agreement

Scope

This License Agreement governs the usage rights for digital content purchased through the online store operated by:

This License Agreement applies in addition to the Terms & Conditions of 3DFlagShop.

By purchasing a digital product, the customer receives the usage rights described in this License Agreement and under the respective license level selected at the time of purchase.

Licensed Content

The licensed content may include, in particular:

  • Animated WEBP files
  • FHD videos – 1920 × 1080 pixels
  • 4K videos – 3840 × 2160 pixels
  • MP4 files
  • WEBM files
  • 30 FPS versions
  • Optional or individually offered 60 FPS versions
  • Custom-created digital content and bespoke productions

The respective product description and the license selected at the time of purchase determine the specific content and scope of the license.

General Grant of Usage Rights

Upon full payment, the customer receives a non-exclusive license to use the purchased digital content in accordance with the selected license level.

Unless expressly agreed otherwise, the license is:

  • Valid for an unlimited period of time
  • Limited to the types of use permitted under the respective license level
  • Granted solely to the customer or for the licensed project
  • Subject to compliance with this License Agreement

The purchase of a license does not transfer any copyright, ownership rights, or other intellectual property rights in the underlying content.

License Levels

Standard / Web License

The Standard / Web License is primarily intended for digital and non-broadcast use.

It permits use in, for example:

  • Websites
  • Blogs
  • Social media posts and profiles
  • YouTube content
  • Presentations
  • Digital presentations
  • Internal corporate projects
  • School and university projects
  • Editorial and informational online content
  • Personal projects

The Standard / Web License does not generally cover traditional commercial advertising campaigns, extensive professional media productions, or television, cinema, or broadcast use where a higher license level is required.

Commercial License

The Commercial License includes the permitted uses of the Standard / Web License and extends them to commercial applications.

It permits use in, for example:

  • Commercial websites
  • Corporate communications
  • Advertising
  • Online and social media advertising
  • Marketing campaigns
  • Product advertising
  • Corporate presentations
  • Corporate films and commercial videos
  • Trade show and event presentations
  • Digital advertising materials
  • Professional client projects created by agencies, designers, and media producers

The Commercial License does not permit the distribution or resale of the original file as a standalone product.

Television, cinema, or extensive broadcast use generally requires a Broadcast License.

Broadcast License

The Broadcast License includes the permitted uses of both the Standard / Web License and the Commercial License and extends them to professional broadcast and media applications.

It permits use in, for example:

  • Television productions
  • Television advertising
  • Streaming productions
  • Cinema productions
  • Cinema advertising
  • Documentaries
  • News and informational productions
  • Professional film productions
  • Professional media productions
  • Broadcast graphics
  • Opening and closing sequences
  • Large-scale audiovisual campaigns

The Broadcast License also does not permit the standalone resale or distribution of the original files.

Use by Agencies and Service Providers

Agencies, design studios, production companies, media organizations, and other professional service providers may use licensed content for specific client projects within the scope of the applicable license.

The following conditions apply:

  • The file may be incorporated into a specific client project.
  • The intended use must be covered by the license level purchased.
  • Employees and contracted service providers may be given technical access to the file where necessary for the project.
  • The original file may not be provided to the client for unrestricted or independent future use.
  • Delivery of the completed project does not grant the client a general license to the original file.
  • If the client wishes to use the original file independently for additional projects, an appropriate separate license is required.

Editing and Modification

Customers may technically and creatively modify purchased content within the scope of the applicable license to adapt it to their project.

Permitted modifications may include, for example:

  • Cropping
  • Scaling
  • Changing dimensions
  • Integration into videos or graphics
  • Combining the content with text, audio, images, or other media
  • Technical format or project-related adjustments

Editing or modifying the content does not create any ownership or copyright rights in the underlying original file.

A modified version may not be offered as a standalone or substantially similar stock, download, or media product.

Prohibition on Resale and Redistribution

Regardless of the license level purchased, the following are prohibited in particular:

  • Reselling the original file
  • Redistributing it free of charge
  • Giving it away
  • Renting or lending it
  • Sublicensing it
  • Publishing it on stock platforms
  • Publishing it on download portals
  • Including it in asset or media libraries for redistribution
  • Distributing it through file-sharing services
  • Making it available as a standalone download

These restrictions also apply to files that have merely been converted or only slightly modified.

Use in Templates, Apps, and Digital Products

Licensed content may be incorporated into templates, apps, games, software, or other digital products only if:

  • The applicable license level covers the intended use
  • The original file cannot be readily extracted or separately used by end users
  • The primary purpose of the product is not to redistribute the licensed file itself

Additional licensing requirements may apply to templates, website builders, apps, games, software products, design systems, or comparable applications.

If there is any uncertainty regarding the intended use, customers should contact 3DFlagShop before using the content.

No Competing Libraries or Services

Purchased content may not be used to create, operate, or materially expand a service that competes with 3DFlagShop, including a:

  • Flag library
  • Stock media library
  • Download platform
  • Asset library
  • Or comparable digital service

Prohibited Content and Uses

Licensed content may not be used in an unlawful manner.

In particular, use is prohibited in contexts that are:

  • Racist
  • Extremist
  • Abusive or defamatory
  • Fraudulent
  • Deliberately misleading
  • Otherwise unlawful

Neutral journalistic, editorial, documentary, historical, scientific, educational, or informational use may be permitted within the scope of the applicable license and applicable law.

The mere display of a flag as part of factual reporting is not prohibited solely because of the symbol depicted.

Political and Sensitive Uses

3DFlagShop provides its content neutrally and without political endorsement or judgment.

Political, historical, or other sensitive representations may be permitted within the scope of the applicable license, provided that the use complies with applicable law and this License Agreement.

The customer is responsible for the specific context in which the content is used.

For particularly sensitive or unusual projects, we recommend contacting 3DFlagShop in advance.

Flags, Coats of Arms, Logos, and Third-Party Rights

Certain flags, coats of arms, logos, trademarks, emblems, and other symbols may be subject to legal restrictions, trademark rights, personality rights, or other third-party rights, depending on the country and intended use.

The 3DFlagShop license covers only those rights that 3DFlagShop is entitled to grant in relation to the respective digital content.

The purchase of a license does not transfer any additional trademark rights, rights relating to official symbols, or other third-party rights.

Customers are responsible for determining whether their intended use requires any additional permissions or rights.

Non-Exclusive License

Unless expressly agreed otherwise in writing, all licenses are granted on a non-exclusive basis.

This means that 3DFlagShop may offer and license the same or similar content to other customers.

Exclusive usage rights require a separate written agreement.

License Term

Unless otherwise specified in the product description or an individual agreement, the purchased license is generally valid for an unlimited period of time.

Continued validity is subject to compliance with the applicable license terms.

End products lawfully created within the scope of the license may generally continue to be used in accordance with the purchased license after completion of the original project.

Custom Productions

Different or additional usage rights may be agreed for custom-created content or bespoke productions.

These may include, in particular:

  • Exclusive usage rights
  • Commercial usage rights
  • Broadcast rights
  • Territorial restrictions
  • Project-specific usage rights
  • Special distribution or publication rights

The respective individual quotation or written agreement shall determine the applicable rights.

Proof of License

Proof of the purchased license may include:

  • Order confirmation
  • Invoice
  • Electronic proof of license
  • Confirmation of the license level purchased

Customers should retain these documents for their records.

Where there is a legitimate reason to do so, 3DFlagShop may request proof of the license purchased.

License Violations

Any use outside the scope of the purchased license constitutes unauthorized use.

In the event of a violation of this License Agreement, 3DFlagShop reserves all applicable contractual and statutory rights.

Where the relevant legal requirements are met, these may include:

  • Requiring the customer to cease the unauthorized use
  • Requiring the purchase or upgrade of the appropriate license
  • Injunctive relief
  • Claims for damages
  • Other remedies available under applicable law

License Upgrades

If the intended use of a previously purchased product expands, it may be possible to upgrade to a higher license level.

Examples include:

  • Standard / Web → Commercial
  • Standard / Web → Broadcast
  • Commercial → Broadcast

Any extended use may generally begin only after the required license or corresponding upgrade has been obtained.

Relationship with the Terms & Conditions

This License Agreement supplements the 3DFlagShop Terms & Conditions.

The Terms & Conditions govern, in particular, the conclusion of contracts, payment, provision of digital content, and general contractual matters.

This License Agreement primarily governs the scope of the usage rights granted for purchased digital content.

Applicable Law

The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law applies only to the extent that it does not deprive them of mandatory consumer protection provisions applicable in the country of their habitual residence.

Final Provisions

If any provision of this License Agreement is or becomes wholly or partially invalid, the applicable statutory provisions shall apply, and the validity of the remaining provisions shall remain unaffected.

Individual written agreements and expressly agreed special licenses shall take precedence over this general License Agreement to the extent that they contain different provisions.
